Terms and conditions
Supplier: VHM Limited, trading as Te Hana House Storage
Yard: 3 Silver Hill Road, Te Hana, Auckland
1. Licence to occupy
The Supplier gives the Customer a licence to keep the house or vehicle described below in the yard. This is a licence, not a lease. The Customer does not get exclusive possession of any part of the yard or any interest in the land, and the Supplier may move it to another position in the yard if reasonably needed.
2. Storage fees
The Customer pays a daily storage fee plus GST at the rate for the term chosen. Standard rate, for a minimum term of 3 months: houses and buildings $0.18 per square metre of floor area per day (minimum $12 per day), motorhomes and campervans up to 8 m $5 per day, buses and motorhomes over 8 m $7 per day. Short-stay rate, for a minimum term of 1 month: houses and buildings $0.22 per square metre per day (minimum $15 per day), motorhomes up to 8 m $6 per day, buses and motorhomes over 8 m $9 per day. A short stay that runs past 3 months moves to the standard rate from then on. Fees are invoiced monthly and payable monthly in advance. The Supplier may change its rates with 30 days' written notice; if the Customer does not accept a change, they may end this agreement before it takes effect without paying for the rest of the minimum term.
3. Access to site
General access to the storage yard is permitted between 7 am and 10 pm daily, unless otherwise agreed with the Supplier.
4. Security and site access
Each Customer is given the padlock key lock box code. The Customer must disable and re-enable the electric fence on entry and exit. A security guard patrols the yard nightly. The yard is monitored by security cameras. Footage is used for security and is handled under the Privacy Act 2020. Ask the Supplier if you want to know more about it.
5. Third-party access
Third parties may only enter the site if accompanied by the Customer. The Customer is responsible for making sure everyone entering under their authority follows these terms.
6. Insurance
Before storage starts, the Customer must hold public liability insurance and insurance for the house itself, and give the Supplier evidence of both. The Customer must keep this cover in place while the house is in the yard.
7. Buses and motorhomes
Any bus, motorhome or campervan stored in the yard must be currently registered, hold a current warrant of fitness or certificate of fitness as the law requires for that vehicle, have road user charges paid where they apply, and be insured for the whole storage period. The Customer must give the Supplier evidence of these before the vehicle arrives and whenever they are renewed. The Supplier may refuse entry to, or ask for the removal of, any vehicle that does not meet these requirements.
8. Site induction
The Customer, or a representative, must complete a site induction before accessing the storage yard.
9. Prohibited activities
The Customer must not carry out repairs, dump waste, store vehicles other than an approved bus or motorhome under clause 7, live or stay overnight in the house or vehicle, connect services, or do anything hazardous or disruptive on site.
10. Liability and risk
Everything stored is at the Customer's risk. The Supplier is not liable for loss, damage or theft unless it is directly caused by the Supplier's gross negligence.
11. Emergency access
The Supplier may access, move or secure any stored item without notice in an emergency or where required by law or regulation.
12. Unpaid fees and lien
The Customer grants the Supplier a lien over the house or vehicle and anything stored with it, to secure all storage fees and other amounts owed. The Customer agrees the Supplier may register this on the Personal Property Securities Register. If fees are overdue by more than 60 days, the Supplier may give the Customer written notice. If the amount owed is still unpaid 30 days after that notice, the Supplier may sell it, keep what it is owed plus its costs of sale, and pay any balance to the Customer.
13. Ending the agreement
Either party may end this agreement with 7 days' written notice, but the agreement cannot end before the minimum term chosen (1 month or 3 months) is up. If the Customer removes the house or vehicle before then, storage fees for the rest of the minimum term are still payable. The Supplier may end the agreement earlier if the Customer breaches these terms. The Customer must remove the house or vehicle and everything else they've stored, and leave the area as they found it.
14. Dispute resolution
Any dispute must first be referred to mediation. Neither party may start court proceedings unless mediation has been attempted in good faith.
15. Force majeure
The Supplier is not liable for failure or delay caused by events beyond its control, including natural disaster, fire, flood, accident or government action.
